Terms of Service — Beamtrace

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Beamtrace service ("Service"), which is operated by Elfsight, SL, a company incorporated in Andorra ("Company", "we", "us", or "our").

By accessing or using Beamtrace ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access or use the Service.

These Terms apply to all users of the Service, including visitors, registered users, and subscribers. Your use of the Service is also governed by our Privacy Policy.

2. Description of Service

Beamtrace is an AI visibility tracking platform that:

Tracks how AI platforms (ChatGPT, Gemini, Claude, Perplexity, etc.) mention and recommend your brand
Monitors your visibility, rankings, and mentions in AI-generated answers
Analyzes competitive positioning in AI search results
Provides analytics, trends, and insights about your AI visibility
Tracks citations and sources that AI platforms use when mentioning your brand
Provides a Strategy: a document describing your current visibility situation, priorities, and a staged sequence of suggested work
Identifies issues with your website, profiles, and public presence, and provides an Action Plan describing each issue, its possible effect on your visibility, and how it may be addressed
Produces suggested text and other draft materials for use when addressing an issue, where a change to your content is involved
Allows you to add and track more than one website within a single account, subject to the limits of your plan
May offer optional assistance with implementing selected improvements on your website or other digital assets

The Service uses automated systems to query AI platforms and analyze responses. We do not guarantee the accuracy, completeness, or timeliness of AI platform responses or our analysis.

Beamtrace may provide a Strategy, an Action Plan, Issues, scores, and other recommendations based on automated analysis, AI-generated outputs, third-party data, and our internal methodologies. These materials are intended to help you identify possible opportunities for improvement, but they do not guarantee any specific result.

3. Strategy, Action Plan, and Issues

3.1 Definitions

"Strategy" means a document made available to you in the Service that may describe your current visibility, priority markets or regions, areas for improvement, a staged sequence of suggested work, and illustrative expectations.

"Action Plan" means the list of Issues made available to you in the Service.

"Issue" means a single item in the Action Plan. An Issue may include: a description of a finding relating to your website, profiles, content, or public presence; an explanation of how that finding may affect your visibility in AI-generated answers; a description of the effect that addressing it may have ("Expected Effect"); instructions describing how it may be addressed ("Fix Instructions"); and suggested text or other draft materials for use in addressing it ("Generated Content").

The Strategy, the Action Plan, and all Issues, including all Expected Effect statements, Fix Instructions, and Generated Content, are provided as recommendations and are subject to this Section.

3.2 Recommendations and No Guarantee

Beamtrace may provide a Strategy, an Action Plan, Issues, scores, priorities, or other guidance intended to help improve your visibility in AI-generated answers, AI search results, and other digital discovery environments.

These recommendations are provided for informational and advisory purposes only. They are not legal, financial, tax, accounting, medical, regulatory, technical, or professional marketing advice, and must not be relied upon as such. If your business operates in a regulated field, you are responsible for obtaining appropriate professional review before acting on any recommendation.

You understand and agree that results may vary and may depend on many factors outside Beamtrace's control, including but not limited to:

changes in third-party AI platforms, search engines, algorithms, models, policies, or data sources;
the quality, accuracy, and consistency of implementation;
your website structure, content, technical setup, reputation, market, industry, location, and competition;
the time required for third-party systems to discover, process, update, or reflect changes;
actions taken by competitors or other third parties.

Beamtrace does not guarantee that following any recommendation, action plan, or suggested improvement will result in improved rankings, visibility, citations, mentions, traffic, conversions, revenue, or business outcomes.

You are responsible for evaluating whether any recommendation is appropriate for your business, website, legal requirements, technical environment, and commercial goals before implementing it.

3.3 Accuracy of Issues

Issues are identified automatically from publicly available information and are indicative only. They may be incomplete, outdated, or incorrect, and may be affected by caching, access restrictions, redirects, bot protection, or changes on third-party platforms.

The presence of an Issue does not establish that a problem exists, and the absence of an Issue does not establish that your website, profiles, or content are correct, complete, secure, accessible, or compliant with any standard or requirement. Beamtrace does not perform an audit, review, or certification of your website or content.

Any explanation of how an Issue may affect your visibility reflects our general understanding of how AI systems may process information. It is not a statement about how any specific AI system treats your business, and the actual behaviour of AI systems is not disclosed by their operators and cannot be verified by us.

You are responsible for verifying any Issue before acting on it.

3.4 Expected Effect, Estimates, and Expectations

The Strategy and the Action Plan may include stages, sequencing, priorities, estimated effort, Expected Effect statements, indicative timeframes, and descriptions of what you may expect over a given period.

All such statements are estimates and illustrative scenarios based on limited information available at the time they were prepared. They are not commitments, forecasts, targets, service levels, or promises of any outcome, and they do not create any obligation for Beamtrace. Actual outcomes may differ materially from any estimate, may take significantly longer, or may not occur at all.

An Expected Effect statement describes a possible outcome of addressing an Issue in isolation. Visibility in AI-generated answers depends on many signals considered together, and addressing any single Issue may produce no measurable effect. No stage, priority, score, or Expected Effect should be interpreted as a statement that a particular result will be achieved, or achieved within a particular period.

3.5 Fix Instructions

Fix Instructions are general guidance. They are not tailored to your specific content management system, theme, hosting, plugins, integrations, or configuration, and may not be applicable or safe in your environment.

Following Fix Instructions may involve changes to your website, code, settings, profiles, or accounts. You are responsible for assessing whether a change is appropriate, for maintaining backups, for testing changes before and after they are applied, and for engaging a qualified professional where appropriate.

Beamtrace is not liable for any error, downtime, data loss, broken functionality, loss of rankings or traffic, or other consequence arising from changes you make, whether or not those changes follow Fix Instructions.

3.6 Information You Provide

The Strategy and the Action Plan are based in part on information you provide or make publicly available, including your business description, services, locations, and competitors. You are responsible for the accuracy and completeness of this information. Inaccurate, incomplete, or outdated input may result in recommendations that are irrelevant, unsuitable, or incorrect for your business.

3.7 Changes to the Strategy and Action Plan

Beamtrace may rebuild, reprioritize, modify, replace, or remove any Strategy, Issue, stage, score, or estimate at any time, including as a result of changes to tracked prompts, competitors, methodology, or third-party platforms. We do not guarantee that any previous version of a Strategy or Action Plan will remain available, and we have no obligation to retain historical versions.

4. Content Generation

4.1 What we produce.

Where addressing an Issue involves a change to your content, the Service may produce suggested text and other draft materials, such as page titles, headings, descriptions, answers to common customer questions, profile and listing text, and similar content ("Generated Content"). Generated Content is produced automatically, is created or assisted by artificial intelligence, and is provided to you as a draft.

4.2 Your review is required.

Generated Content is not reviewed by a person before it reaches you. You are solely responsible for reviewing, editing, approving, and publishing it. Before publishing, you must verify that it is accurate, truthful, not misleading, and compliant with all laws and regulations applicable to your business, including advertising, consumer protection, and any sector-specific requirements. You must not publish Generated Content that you have not reviewed.

4.3 Accuracy and claims.

Generated Content may contain factual statements about your business, claims about your services, superlatives, comparative statements, pricing or availability information, credentials, or references to third parties. These may be inferred from limited information and may be incorrect. Beamtrace does not verify them.

4.4 Originality.

Generated Content is produced from models trained on large volumes of material and may resemble content published by others. Beamtrace does not warrant that Generated Content is original or that it does not infringe the rights of any third party, and makes no representation that it is unique to you. Similar or identical content may be produced for other users.

4.5 Rights.

As between you and Beamtrace, you may use, modify, and publish Generated Content delivered to you for your own business purposes, or for the business of a party you are authorized to represent. Beamtrace claims no ownership of Generated Content once delivered. This does not transfer to you any rights in the Service itself, in our models, methodology, or templates, or in any material owned by a third party.

4.6 Inputs.

To produce Generated Content we may process your existing content, your business information, and publicly available information about your market. You confirm that you have the right to have any material you supply processed for this purpose.

4.7 Disclosure obligations.

Some platforms, regulators, and jurisdictions require content produced with artificial intelligence to be identified as such. You are responsible for determining whether any such obligation applies to you and for complying with it.

4.8 Limits and refusal.

Content generation is subject to the limits of your plan and to fair use. We may apply rate limits, and we may decline to produce Generated Content, including where a request appears unrelated to a website in your account, appears intended to generate content at scale for other purposes, or would produce material we consider unlawful, deceptive, or otherwise inappropriate.

4.9 Training.

Our use of your content and of material you supply is described in our Privacy Policy.

5. Issue Status

5.1

The Action Plan allows you to mark Issues as completed or dismissed. Statuses are recorded at your own direction and for your convenience only.

5.2

Marking an Issue as completed is your own declaration. Beamtrace does not verify it. It does not confirm that a change was made, that it was made correctly, that it remains in place, that the finding has been resolved, or that any effect will follow.

5.3

Statuses, completion counts, and any related progress indicators do not reflect the actual state of your website, profiles, or content, and must not be relied upon as a record of work performed.

6. Issues Involving Third-Party Platforms

6.1

Some Issues relate to third-party platforms, including business profiles, directories, review platforms, marketplaces, social networks, and community sites. You are responsible for complying with the terms, policies, and guidelines of each such platform.

6.2

Beamtrace is not responsible for the acceptance, rejection, moderation, removal, restriction, or suspension of any listing, profile, content, or account on a third-party platform, or for any consequence of such action.

6.3

You must not use the Strategy, the Action Plan, any Issue, or any Generated Content to create or solicit fake, incentivized, or misleading reviews or testimonials, to misrepresent your business, to publish content on behalf of a person or business you do not represent, or to engage in any practice prohibited by a third-party platform or by applicable law. We may suspend or terminate access where we reasonably believe such activity is taking place.

7. Use on Behalf of Others

If you use the Service on behalf of a third party, including as an agency, consultant, or contractor, you confirm that you are authorized to do so and to act for that party in relation to their website, profiles, and content.

You are responsible for reviewing any Strategy, Issue, or Generated Content before sharing it with that party, for making the limitations and disclaimers in these Terms known to them, and for any material you distribute under your own or a client's brand. Beamtrace has no direct relationship with, and assumes no obligations toward, your clients.

8. Optional Implementation Support

Beamtrace may, at its sole discretion, offer optional assistance with implementing selected improvements or actions on your website, content, accounts, or other digital assets ("Implementation Support"). This may include reviewing your setup, suggesting changes, or, where applicable, performing limited actions on your behalf.

Implementation Support may be offered as part of a promotion, trial, subscription plan, one-time offer, or other product experience. Unless expressly stated otherwise in writing, Implementation Support is provided on a best-effort basis and does not create any obligation for Beamtrace to complete any specific task.

While you may request a specific task or action, Beamtrace does not guarantee that the requested task will be accepted, performed, completed, or completed within any specific timeframe.

Beamtrace reserves the right, at its sole discretion, to:

decline any requested task;
modify or limit the scope of a requested task;
prioritize tasks differently;
request additional information, access, or approval before proceeding;
substitute a requested task with an alternative action;
stop or refuse Implementation Support if we believe the task is impractical, unsafe, unlawful, too complex, outside the intended scope of the offer, or unlikely to provide meaningful value.

If Beamtrace determines that a requested task is not appropriate, feasible, or aligned with best practices, we may suggest an alternative action that we reasonably believe may provide greater value or impact. However, we do not guarantee that any alternative action will produce any specific result.

You remain fully responsible for reviewing, approving, and accepting any changes made to your website, content, accounts, systems, or digital assets, whether those changes are made by you, by Beamtrace, or with Beamtrace's assistance.

By granting Beamtrace access to your website, accounts, systems, or third-party services, you confirm that:

you have the full legal right and authority to provide such access;
providing such access does not violate any agreement, policy, law, or third-party right;
you understand and accept the risks associated with granting access to third-party systems;
you are responsible for maintaining appropriate backups, permissions, and security controls.

Beamtrace will use such access solely for the purpose of providing the agreed Implementation Support within a reasonable scope. You may revoke access at any time, but doing so may prevent us from providing or completing Implementation Support.

Beamtrace shall not be liable for any issues, losses, damages, downtime, data loss, ranking changes, traffic changes, business interruption, or unintended consequences arising from or related to Implementation Support, except where liability cannot be excluded under applicable law.

9. Multiple Websites

9.1

Depending on your plan, you may add and track more than one website within a single account. Each website you add is tracked separately, and a separate Strategy and Action Plan may be provided for it.

9.2

For each website you add, you confirm that you own it or are otherwise authorized to monitor it and to act in relation to its content and associated profiles. You must not add a website solely in order to monitor a competitor, or any website you have no right to track.

9.3

Anyone with access to your account can view all websites in that account, together with their Strategies, Issues, Generated Content, and data. You are responsible for who has access to your account.

9.4

We may remove a website from your account, or suspend tracking for it, if we reasonably believe it was added in breach of this Section, or if the number of websites in your account exceeds the limits of your plan.

9.5

Data associated with a website you remove may be deleted and may not be recoverable.

10. Account Registration

To use the Service, you must:

Be at least 18 years old or have parental consent
Provide accurate, current, and complete information during registration
Maintain and update your account information to keep it accurate
Maintain the security of your account credentials
Accept responsibility for all activities under your account

You may not share your account credentials or allow others to access your account. You must notify us immediately of any unauthorized access or security breach.

11. Acceptable Use

You agree not to:

Use the Service for any illegal purpose or in violation of any laws
Violate or infringe upon the rights of others (intellectual property, privacy, etc.)
Attempt to reverse engineer, decompile, or extract source code from the Service
Use automated systems (bots, scrapers) to access the Service without authorization
Interfere with or disrupt the Service, servers, or networks
Transmit viruses, malware, or other harmful code
Use the Service to track brands, competitors, or content you do not have the right to monitor
Impersonate others or provide false information
Resell, sublicense, or redistribute the Service without permission
Publish Generated Content without reviewing it, where doing so results in false, misleading, or unlawful statements
Use the Service primarily as a general content generation tool, or to produce content for websites, businesses, or purposes unrelated to the websites in your account
Create, solicit, or facilitate fake reviews, ratings, or testimonials
Use the Service, or act on any Issue, on behalf of a business you are not authorized to represent

12. Subscriptions and Payments

12.1 Subscription Plans

The Service offers various subscription plans with different features and limits. Subscription fees are billed in advance on a monthly or annual basis, as selected during checkout.

12.2 Payment Processing

Payments are processed by Paddle, our third-party payment provider. By subscribing, you agree to Paddle's terms and conditions. We do not store or process credit card information directly.

12.3 Billing and Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method for renewal fees.

12.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will continue to have access to paid features until the end of the period.

12.5 Price Changes

We reserve the right to modify subscription prices. Price changes will be communicated in advance and will apply to subsequent billing periods. Existing subscribers may be grandfathered at current rates for a specified period.

12.6 Per-Website Charges

Where your plan is priced by the number of tracked websites, adding a website during a billing period will increase your subscription fee. Unless stated otherwise at checkout, the additional amount for the current period is charged on a pro rata basis at the time the website is added, and the full amount applies from the next renewal.

Removing a website takes effect immediately for tracking purposes and reduces your fee from the next billing period. Amounts already paid for the current period are not refunded, in whole or in part, when a website is removed.

13. Intellectual Property

13.1 Our Property

The Service, including all software, designs, text, graphics, logos, and other content, is owned by Beamtrace or our licensors and protected by copyright, trademark, and other intellectual property laws.

13.2 Your Content

You retain ownership of any data, content, or information you provide to the Service (brand names, tracking requests, etc.). By using the Service, you grant us a license to use, process, and store this information to provide the Service.

13.3 AI Platform Responses

AI platform responses and generated content are subject to the terms and policies of the respective AI platforms (OpenAI, Google, Anthropic, etc.). We do not claim ownership of AI-generated content.

13.4 Generated Content

Rights in Generated Content are described in Section 4. Generated Content may be produced using third-party AI providers, and their terms may apply to the underlying models and services. We do not claim ownership of Generated Content delivered to you, and we make no warranty as to its originality or non-infringement.

14. Service Availability and Modifications

We strive to provide reliable service but do not guarantee:

Uninterrupted or error-free operation
Availability of specific AI platforms or features
Accuracy or completeness of tracking data
Timeliness of data updates or reports

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may also impose limits on usage or restrict access to certain features.

15. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability, fitness for a particular purpose, or non-infringement
Accuracy, reliability, or completeness of tracking data or analytics
Availability or performance of AI platforms we query
Results or outcomes from using the Service

AI platforms may change their responses, algorithms, or policies at any time, which may affect tracking accuracy. We are not responsible for changes made by third-party AI platforms.

Any Strategy, Action Plan, Issues, scores, insights, recommendations, or implementation assistance provided by Beamtrace are made available on an "as is" and "as available" basis.

Beamtrace does not warrant or guarantee that:

any recommendation will be accurate, complete, current, or suitable for your specific business;
any action or improvement will increase your visibility in AI-generated answers, AI search results, search engines, or any other third-party platform;
any implementation assistance will be error-free, uninterrupted, or produce the expected result;
third-party AI platforms, search engines, or other services will discover, process, interpret, or reflect changes in any particular way or timeframe.
any Issue will be accurate, complete, or current, or that all relevant issues will be identified;
any explanation of how an Issue affects visibility reflects the actual behaviour of any AI system;
any Expected Effect, stage, priority, estimate, or indicative timeframe will be accurate, achievable, or suitable for your business;
any Fix Instructions will be applicable, safe, or effective in your specific environment;
Generated Content will be accurate, original, non-infringing, compliant with applicable law, or fit for publication.

Some insights, recommendations, and outputs provided by Beamtrace may be generated or assisted by artificial intelligence. Such content may be incomplete, outdated, inaccurate, or based on limited available information. You should independently review and validate any material before relying on it.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEAMTRACE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Damages resulting from use or inability to use the Service
Errors, omissions, or inaccuracies in tracking data or analytics
Actions or decisions made based on Service data or insights
Results or lack of results from following a Strategy, an Action Plan, any Issue, or other recommendation
Issues, losses, or unintended consequences arising from Implementation Support
Changes in visibility, rankings, citations, mentions, traffic, conversions, revenue, or business outcomes
Decisions made by third-party AI platforms, search engines, algorithms, models, or other external systems
Consequences of publishing Generated Content, including third-party claims, intellectual property claims, regulatory action, or penalties applied by any platform
Changes you make to your website, content, settings, or accounts, whether or not they follow Fix Instructions
Reliance on any Issue, including an inaccurate Issue or an issue not identified by the Service
Reliance on statuses, scores, priorities, stages, Expected Effect statements, or estimates
Removal, restriction, or suspension of your accounts, listings, or profiles on third-party platforms

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

17. Indemnification

You agree to indemnify, defend, and hold harmless Beamtrace and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any rights of others
Content or data you provide to the Service
Your implementation of any Strategy, Action Plan, Issue, or other recommendation
Access you provide to Beamtrace for Implementation Support
Changes made to your website, accounts, systems, content, or digital assets with your authorization
Your publication or distribution of Generated Content
Any claim that Generated Content you published infringes the rights of a third party
Any Strategy, Action Plan, report, or content you share with your clients or other third parties
Your use of the Service on behalf of a third party without proper authorization

18. Termination

We may terminate or suspend your account and access to the Service:

Immediately, if you violate these Terms
With notice, for any reason or no reason
If you fail to pay subscription fees

Upon termination, your right to use the Service ceases immediately. We may delete your account and data, subject to our data retention policies and legal requirements.

You may terminate your account at any time by canceling your subscription and requesting account deletion.

19. Third-Party Services

The Service integrates with and relies on third-party services, including:

AI platforms (ChatGPT, Gemini, Claude, Perplexity, etc.)
Payment processors (Paddle)
Hosting and infrastructure providers
Analytics and tracking services

Your use of third-party services is subject to their respective terms and policies. We are not responsible for the availability, accuracy, or practices of third-party services.

20. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law. You waive your right to a jury trial and to participate in class action lawsuits.

21. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Beamtrace operates, without regard to conflict of law principles.

22. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically for changes.

23. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
