1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Beamtrace service ("Service"), which is operated by Elfsight, SL, a company incorporated in Andorra ("Company", "we", "us", or "our").

By accessing or using Beamtrace ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access or use the Service.

These Terms apply to all users of the Service, including visitors, registered users, and subscribers. Your use of the Service is also governed by our Privacy Policy.

2. Description of Service

Beamtrace is an AI visibility tracking platform that:

Tracks how AI platforms (ChatGPT, Gemini, Claude, Perplexity, etc.) mention and recommend your brand
Monitors your visibility, rankings, and mentions in AI-generated answers
Analyzes competitive positioning in AI search results
Provides analytics, trends, and insights about your AI visibility
Tracks citations and sources that AI platforms use when mentioning your brand

The Service uses automated systems to query AI platforms and analyze responses. We do not guarantee the accuracy, completeness, or timeliness of AI platform responses or our analysis.

3. Account Registration

To use the Service, you must:

Be at least 18 years old or have parental consent
Provide accurate, current, and complete information during registration
Maintain and update your account information to keep it accurate
Maintain the security of your account credentials
Accept responsibility for all activities under your account

You may not share your account credentials or allow others to access your account. You must notify us immediately of any unauthorized access or security breach.

4. Acceptable Use

You agree not to:

Use the Service for any illegal purpose or in violation of any laws
Violate or infringe upon the rights of others (intellectual property, privacy, etc.)
Attempt to reverse engineer, decompile, or extract source code from the Service
Use automated systems (bots, scrapers) to access the Service without authorization
Interfere with or disrupt the Service, servers, or networks
Transmit viruses, malware, or other harmful code
Use the Service to track brands, competitors, or content you do not have the right to monitor
Impersonate others or provide false information
Resell, sublicense, or redistribute the Service without permission

5. Subscriptions and Payments

5.1 Subscription Plans

The Service offers various subscription plans with different features and limits. Subscription fees are billed in advance on a monthly or annual basis, as selected during checkout.

5.2 Payment Processing

Payments are processed by Paddle, our third-party payment provider. By subscribing, you agree to Paddle's terms and conditions. We do not store or process credit card information directly.

5.3 Billing and Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method for renewal fees.

5.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will continue to have access to paid features until the end of the period.

5.5 Price Changes

We reserve the right to modify subscription prices. Price changes will be communicated in advance and will apply to subsequent billing periods. Existing subscribers may be grandfathered at current rates for a specified period.

6. Intellectual Property

6.1 Our Property

The Service, including all software, designs, text, graphics, logos, and other content, is owned by Beamtrace or our licensors and protected by copyright, trademark, and other intellectual property laws.

6.2 Your Content

You retain ownership of any data, content, or information you provide to the Service (brand names, tracking requests, etc.). By using the Service, you grant us a license to use, process, and store this information to provide the Service.

6.3 AI Platform Responses

AI platform responses and generated content are subject to the terms and policies of the respective AI platforms (OpenAI, Google, Anthropic, etc.). We do not claim ownership of AI-generated content.

7. Service Availability and Modifications

We strive to provide reliable service but do not guarantee:

Uninterrupted or error-free operation
Availability of specific AI platforms or features
Accuracy or completeness of tracking data
Timeliness of data updates or reports

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may also impose limits on usage or restrict access to certain features.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability, fitness for a particular purpose, or non-infringement
Accuracy, reliability, or completeness of tracking data or analytics
Availability or performance of AI platforms we query
Results or outcomes from using the Service

AI platforms may change their responses, algorithms, or policies at any time, which may affect tracking accuracy. We are not responsible for changes made by third-party AI platforms.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEAMTRACE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Damages resulting from use or inability to use the Service
Errors, omissions, or inaccuracies in tracking data or analytics
Actions or decisions made based on Service data or insights

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Beamtrace and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any rights of others
Content or data you provide to the Service

11. Termination

We may terminate or suspend your account and access to the Service:

Immediately, if you violate these Terms
With notice, for any reason or no reason
If you fail to pay subscription fees

Upon termination, your right to use the Service ceases immediately. We may delete your account and data, subject to our data retention policies and legal requirements.

You may terminate your account at any time by canceling your subscription and requesting account deletion.

12. Third-Party Services

The Service integrates with and relies on third-party services, including:

AI platforms (ChatGPT, Gemini, Claude, Perplexity, etc.)
Payment processors (Paddle)
Hosting and infrastructure providers
Analytics and tracking services

Your use of third-party services is subject to their respective terms and policies. We are not responsible for the availability, accuracy, or practices of third-party services.

13. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law. You waive your right to a jury trial and to participate in class action lawsuits.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Beamtrace operates, without regard to conflict of law principles.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically for changes.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
